Imports from North America
We want to import tools from the USA. In Europe, there is already an importer, so meaning parallel imports from our side. Is this legal? The goods we import don’t have a CE mark, but the goods of the importer have. What about our goods? Can we give a CE mark?
That is how it is regulated in the contract. If the importer has an exclusive contract for the distribution of certain products in the EU, then this may cause problems. If this is not stipulated in a contract, the manufacturer may also supply to others. That means you are free to sell these products.
In addition, you have to check who is responsible for the CE marking. Has this been done at the initiative of the manufacturer in the USA or at the initiative of the importer.
